Welcome to My Homegirl. These Terms of Service ("Terms") are an agreement between you and MyHomegirl AI, LLC, a Mississippi limited liability company ("MyHomegirl," "we," "us," or "our"). They cover your use of the My Homegirl texting service, the MyHomegirl.ai website, and anything else we offer that links to these Terms (together, the "Service").

By texting our number, signing up on our website, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. What My Homegirl is

My Homegirl is an AI best friend and accountability partner that you talk to by text message. There is no app to download. You text a phone number over iMessage or SMS, and Homegirl texts you back.

Homegirl can:

Read and respond to text messages, photos, voice notes, and videos you send.
Reply with GIFs, provided through GIPHY.
Remember context from your past chats so conversations feel continuous.
Send you check-ins and reminders you ask for or agree to.

Homegirl is powered by artificial intelligence. You are talking to a computer program, not a human.

A new and growing service. My Homegirl is new, and we are still building it. Features, limits, and how Homegirl talks may change, and some things may not work perfectly yet. We may add, change, or remove features at any time.

2. Who can use the Service

You must be at least 18 years old to use the Service. Homegirl uses mature language, cursing, and adult humor, so the Service is not meant for minors.

By using the Service, you confirm that:

You are at least 18 years old.
You are the owner or authorized user of the phone number you text from.
You are able to form a binding contract, and you are not barred from using the Service under any applicable law.

If we learn that someone under 18 is using the Service, we may end their access and delete their information.

3. Text messaging terms

Consent. When you text our number or sign up to text with Homegirl, you agree that we may send recurring text messages to that number. These include Homegirl's replies, check-ins and reminders, service and account notices, support messages, and occasional updates about My Homegirl. Some messages are sent automatically. Consent to receive messages is not a condition of any purchase.

Message frequency. Message frequency varies based on how you use the Service.

Rates. Message and data rates may apply. Your mobile carrier's normal fees apply to messages you send and receive. We are not responsible for those charges.

Stop messages. Text STOP at any time to stop receiving messages. We will send one message confirming you've been unsubscribed, and then we will stop texting you. To start again, text START to the same number.

Help. Text HELP for help, or email admin@myhomegirl.ai.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, your device, and third party services like Apple iMessage, and we can't guarantee every message will arrive.

Your mobile information. We do not share your phone number or your text messaging consent with third parties for their marketing purposes. See our Privacy Policy.

Your number. If you change or give up your phone number, please text STOP from that number first, or email us, so the next owner of that number doesn't receive your messages.

4. Group chats

If you add Homegirl to a group chat, or a group chat includes Homegirl, you are responsible for making sure everyone in it knows Homegirl is there, is 18 or older, and agrees to these Terms and our Privacy Policy. A group chat is not private. Homegirl sees the messages sent in it, and everyone in the chat sees her replies. We may stop replying in, or leave, any group chat at any time.

5. Free plan, limits, and paid plans

The Service is currently free to use, with a daily message limit. We may change the daily limit at any time. When you hit the limit, Homegirl may stop replying until the next day.

We may offer paid plans in the future. If we do, prices and plan details will be shown to you before you pay, and payments will be processed by Stripe. Unless we tell you otherwise when you buy, paid plans renew automatically until you cancel, you can cancel at any time to stop future charges, and payments are non-refundable except for duplicate charges or billing errors we confirm recommended, confirm. You are responsible for any taxes that apply.

6. Homegirl is not a professional, and not for emergencies

Homegirl is a friend and accountability partner, not a professional. Homegirl is not a therapist, counselor, doctor, nurse, lawyer, or financial advisor. Nothing she says is medical, mental health, legal, financial, tax, or other professional advice, and she is not a substitute for diagnosis, treatment, or professional care. Talk to a qualified professional before making important decisions about your health, legal matters, or money.

Homegirl is not for emergencies. She can't call for help, contact anyone for you, or monitor your safety. If you are in crisis or thinking about hurting yourself, call or text 988 (the Suicide and Crisis Lifeline in the US). If you or someone else is in immediate danger, call 911 or your local emergency number.

You are responsible for your own choices, actions, and well being. To the fullest extent the law allows, MyHomegirl is not responsible for any harm, injury, or other outcome that results from decisions you make or actions you take while using the Service.

7. AI can be wrong, so don't rely on it alone

Homegirl's replies are generated by AI and can be inaccurate, incomplete, outdated, offensive, or wrong for your situation. She may misunderstand you, misread a photo or voice note, bring up something from a past chat at the wrong time, or say something confidently that isn't true. Don't rely on Homegirl's replies as your only source of information or as a substitute for your own judgment. Double check anything important. You are responsible for how you use what she says.

8. Mature content

Homegirl is designed to talk like a real friend. That means she curses, jokes, roasts, and keeps it real. By using the Service, you understand that her replies may include profanity and mature humor. If that's not for you, the Service may not be a good fit.

9. Acceptable use

We want Homegirl to be a good friend to everyone, so please don't use the Service to:

Break any law, or help anyone else break the law.
Harass, bully, threaten, exploit, or harm anyone, including yourself, or ask Homegirl to do any of that.
Send or request any sexual content involving minors, or sexual, degrading, or fake images of a real person.
Share someone else's private information, such as their health details, contact information, or photos, without their permission.
Track, monitor, or spy on another person through Homegirl.
Send content that infringes someone else's copyright, trademark, privacy, or other rights.
Send spam, malware, or automated or bulk messages.
Try to hack, overload, scrape, reverse engineer, or interfere with the Service, or get around the daily limit or other restrictions.
Try to trick the AI into producing harmful content, or into revealing our systems, prompts, or other users' information.
Pretend to be someone else, or text from a number you don't have permission to use.
Resell, copy, or build a competing product from the Service or its outputs.

We may limit, suspend, or end access for anyone who breaks these rules.

10. Your content and how we use it

You own your content. The messages, photos, voice notes, videos, and other content you send ("Your Content") belong to you.

License to us. You give us a worldwide, non-exclusive, royalty free license to host, store, copy, process, transmit, and use Your Content to run, maintain, provide, and improve the Service, including sending it to the service providers described in our Privacy Policy. This includes anything you tell Homegirl about other people.

Using conversations to improve and train Homegirl. We use customer conversations, including Your Content and Homegirl's replies, to improve and train Homegirl's AI. This can include our team reviewing conversations and using them as examples to train or tune AI models. You give us permission to do this as part of your license above. You can opt out of training at any time, as explained in our Privacy Policy.

Your responsibility. You confirm you have the right to send Your Content, including information about other people, and that it doesn't break these Terms or the law.

11. Our intellectual property

The Service, including the My Homegirl name, the MyHomegirl.ai brand, logos, website, Homegirl's personality and character, and our software, is owned by MyHomegirl AI, LLC and protected by intellectual property laws. We give you a limited, personal, non-transferable, revocable right to use the Service for your own non-commercial use under these Terms. You may not use our name or logos without our written permission.

AI replies. Subject to these Terms, you may use the replies Homegirl sends you for your own personal purposes. Replies may be similar to replies other users receive, and we don't guarantee they are unique.

Feedback. If you send us ideas or feedback, we may use them without any obligation to you.

12. Third party services

The Service depends on third party services, such as phone carriers, Apple iMessage, Sendblue, AI model providers, GIPHY, and, in the future, Stripe. Those services have their own terms and policies, and we are not responsible for their content, performance, or outages. GIFs are provided by GIPHY.

13. Privacy

Our Privacy Policy explains how we collect, use, and share your information, including how we use conversations to train Homegirl and how our website may use cookies and pixels from advertising and analytics partners. It also explains how to opt out of targeted ads. It is part of these Terms.

14. Ending the Service

You can stop using the Service at any time by texting STOP. To also ask us to delete your data, follow the steps in our Privacy Policy.

We may suspend or end your access at any time, with or without notice, if we believe you broke these Terms, if required by law, or if we change or discontinue the Service. We may keep some information after your access ends where the law requires it or for legitimate reasons like preventing fraud and resolving disputes. Sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and dispute resolution) will continue after your access ends.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE, THAT MESSAGES WILL BE DELIVERED, OR THAT ANY AI REPLY WILL BE ACCURATE OR SUITABLE FOR YOU. SOME STATES DON'T ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, MYHOMEGIRL AI, LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, ANY AI REPLY, OR CONTENT SENT BY OTHER PEOPLE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT BE MORE THAN THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50. [FOUNDER TO CONFIRM: liability cap amount] SOME STATES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

Indemnity. You agree to defend and hold harmless MyHomegirl AI, LLC from claims, losses, and costs (including reasonable attorneys' fees) that come from your breaking these Terms or the law, from Your Content, or from adding Homegirl to a group chat in a way these Terms don't allow.

17. Dispute resolution, arbitration, and class action waiver

Talk to us first. If you have a problem with the Service, email admin@myhomegirl.ai and give us 30 days to try to fix it informally.

Arbitration. If we can't resolve it, you and MyHomegirl agree that any dispute related to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either of us may bring an individual claim in small claims court. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules recommended, confirm, and will take place in Mississippi or by video, unless we both agree otherwise.

Class action waiver. You and MyHomegirl agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not combine more than one person's claims.

Opting out of arbitration. You can opt out of this arbitration agreement by emailing admin@myhomegirl.ai within 30 days of first using the Service, with your name, phone number, and a clear statement that you want to opt out of arbitration.

18. Governing law and courts

These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of law rules. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Mississippi recommended, confirm.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the new version on this page and change the "Last updated" date. For important changes, we'll also give you notice, such as by text message or on our website. If you keep using the Service after changes take effect, you accept the updated Terms.

20. Other legal terms

These Terms and our Privacy Policy are the entire agreement between you and us about the Service, and they replace any earlier agreements. If any part of these Terms can't be enforced, the rest stays in effect. If we don't enforce a part of these Terms right away, that doesn't mean we give up the right to enforce it later. You may not transfer these Terms without our permission, but we may transfer them as part of a merger, sale, or similar event.
